Nike Sues the Shoe Surgeon for US$60M
The Shoe Surgeon takes a blow from Nike right after Goyard took the first swing.
If things weren’t already dicey for The Shoe Surgeon, with Goyard recently bringing a Trademark Infringement Lawsuit against him, they just did. On 15 July, Nike sued him for US$60M due to his alleged “illicit Nike empire” and Surgeon Academy courses.
Nike claims The Shoe Surgeon, known for his high-end custom creations based on popular Nike silhouettes, has infringed on over 30 of its trademarks. The compensation it is seeking covers damages, which it alleges represent “trebled profits from counterfeiting” by The Shoe Surgeon, along with attorney fees.
While The Shoe Surgeon has collaborated with Nike in the past on one-off pieces for athletes like LeBron James, Nike argues that these collaborations were limited exceptions. The lawsuit highlights The Shoe Surgeon’s practice of creating and selling custom Nikes without authorization, as well as offering classes that teach others how to replicate Nike’s designs.
According to Nike’s PR team, the lawsuit is a last resort after years of unsuccessful attempts to privately resolve the issue. They claim The Shoe Surgeon continued to expand his business while allegedly promising to respect Nike’s intellectual property rights.
